Researchers recommend steps to curb gun violence, and politicians write legislature to ensure it.  But, the violence continues.  Why?  The same reason that we have an opioid crisis despite legislation banning drugs:  Legislation is not the answer!

Criminals have to comply with legislation for it to be effective, and by their very nature, they don’t.  So, only the law-abiding, who are not a problem to anyone, comply with the laws.  They get disarmed, the size of their magazines limited, the types of guns restricted, their backgrounds checked, their fingerprints records, their license fees demanded, and….they weren’t the problem in the first place.  But now, further disarmed, are easy targets for the criminals that laughed at the laws.

Does anyone really expect criminals to eschew higher capacity magazines?  To give up their illegal guns?  Of course not.  So, the gun violence problem remains, and may even increase as citizens are disarmed, calling politicians to create even more ineffective laws.  And the disarmament of the law-abiding continues, while the criminals’ power unilaterally increases.  What BULLSHIT!

Once again, “researchers”, either incompetent or by political agenda, mistake correlation with causality.  Dangerous neighborhoods beget law-abiding people to request concealed carry permits for their protection.  It is the dangerous neighborhoods that are the causal factor.  Concealed carrying citizens do not make neighborhoods dangerous.

Look no further than Chicago, where obtaining a concealed carry permit is virtually impossible.  Chicago has the strictest gun laws in the country, yet the highest homicide rates.  That example, alone, should tell the reader that this “study” is manure; pure garbage.


Sadly, we are permeated with BULLSHIT throughout our society.  People killing in the name of religion, people spreading viruses and other malware, politicians defying our Constitution, pundits lying to the public, cannabis is illegal while countless harmful drugs– many endorsed by the FDA– are FAR more dangerous.  The list goes on.

People want “common sense” gun control, yet criminals heed no laws.  Heroin is against the law, but Vicodin is OK.  Marijuana is against the law, but alcohol is OK.  In New York, it is OK to have a gun that holds 6 bullets, but one holding 7 is illegal.  Baseball bats are legal everywhere, but machine guns are not.  It’s OK for an adult to have sex with an 18 year old, but one day before that critical birthday will land the person in prison.


The common theme among most of our laws involves thresholds—speed limits, gun magazine capacity, chemical concentration, age, quantities, and so on.  But, based on common sense?  Hardly!  What decides that 6 bullets are OK and 7 is not?  What determines that 18 is “adult” while 17.999 is not.  And why is a natural form of medication illegal, while a synthesized analog is not?  Why is it legal to smoke nutmeg, but not marijuana?  And, is a thug with a baseball bat somehow more acceptable than a a trained firearms instructor with a machine gun?  Common sense?  That’s laughable.


It’s not difficult to imagine how these thresholds were created, nor why—statistics.  Most 18 year olds have reached a given level of maturity.  Self defense does not usually require dozens of bullets, so a room full of people argued and decided on a specific limit, above which would land you in jail.  And, people who need pain medication should get a prescription from a doctor, after all—it’s common sense.  It is?  Why?  That’s easy—most people are not trained in medicine and pharmacology, while most medical doctors are.  Again, statistics, thresholds, pigeon holing, labeling, etc.  I could be an opiate expert, who teaches doctors, but if I acquired my own opiates without a doctor’s prescription, I could be in deep trouble.


How many bullets are needed for self defense?  It depends on dozens of factors—how accurate can the victim shoot?  How far away is the attacker?  How many attackers are there?  What weapons do they have?  What caliber bullet is used?  Where did the bullets hit the attacker?  Is the attacker in a drug-induced rage?  In many successful self-defense situations, 0-1 bullets are sufficient.  Merely showing a gun often stops the attack successfully.  But, if 2-3 drug-crazed attackers are determined to assault you, 30 rounds might not be enough.  Regardless of the usual number, statistically, the outliers are common, and the spread far and wide.  Common sense?  It depends on the situation, and having more at hand is much better than running out.


Common sense used to be used by judges and courts, but overzealous legislators have written mandatory sentences which do not differentiate between an 80 year old woman in New York City, who has been beaten and raped repeatedly, by several attackers at a time, and had a 10-round magazine, and a habitual rapist who also had a 10-round magazine.  Under these mandatory sentencing laws, a judge is precluded from using common sense and must sentence both to the same prison term.  There are people in prison for decades over marijuana possessions, while child molesters go free after 2-3 years.  Common sense?


Instead of mandatory sentences for possession of things, wouldn’t true common sense focus on what the possessors did with these things?  Then, the little old lady defending herself with an AR-15 containing a 30-round magazine would be aquitted, while the would-be rapist with a one-shot derringer would be imprisoned.  With common sense in use, people caught with drugs would be encouraged to attend drug rehab programs, while violent criminals would be imprisoned.  And, a judge might look at an 18 year old man and a 17.9 year old woman, not as a statutory rape situation, but as two kids in love.


Banning or restricting things is doomed to failure, if people are motivated toward these things.  A much better approach would be to ban or restrict behaviors and activities!  This way, owning a gun or possessing some weed would not be illegal, but obnoxious public intoxication (does it matter on what?) would be, as would using a gun to commit a crime, regardless of how many rounds were held in its magazine.  This would be common sense legislation!

I know that most of you follow this blog for the cannabis news and information, but gun rights are somewhat related.  Consider:  Where in the Constitution does it empower the federal government to regulate drugs, especially plants?  They circumvented this by putting a ridiculous tax on cannabis, that no one could or would pay for a tax stamp, and would not issue it without showing proof that you had taxable cannabis.  If you showed the cannabis, you would be busted for having it without a tax stamp– a stamp that you could not get without showing it, a classic Catch-22.  No wonder people hate lawyers!  But, more to the point, this is just one example of how lawless our government has become, through legal maneuvers, twists, and outright usurpation of power, like Obama is doing.

So, listen to what this man points out about laws and rights.  Call out your politicians on BOTH, cannabis as well as guns.  Point out that they are breaking the supreme law of the land.  Fight back!  Let your representatives know that you will vote them out if they do not heed the will of the people.  TAKE BACK OUR GOVERNMENT!

There is a lot of anti-gun propaganda being foist on us incessantly, touting how great it is in the U.K., because guns are illegal.  Well, they have THREE TIMES the number of assaults, rapes, and violent robberies than the U.S. does, maybe more.

This definitely belongs in the BULLSHIT category of misleading the public.  Remember– when seconds count, the police are only minutes away.  People– citizens, victims– are the first responders to a crime.  In Israel, 2 days ago, A Palestinian threw acid on a family and an armed passer-by shot the Palestinian and held him until police arrived.

Guns do not kill, but ANY weapon in a criminal’s hands, can and often do.  Law-abiding gun owners are RARELY a problem to anyone, yet the naive pass restrictions on the 99.9999% of gun owners who are NOT a problem to anyone, in a misguided attempt to thwart the 0.0001% of the criminals….who do NOT heed the new laws (or old ones) in the first place.  Folks, think rationally, vote rationally.

This pro 2nd Amendment video epitomizes what is wrong with our country.  The 2nd Amendment explicitly states that our rights to bear arms “…shall not be infringed”.  Moreover, the 10th Amendment explicitly states that powers not granted to the federal government, belong to the states.  Yet, federal raids for cannabis continue in states that have legalized cannabis.  What makes the government– ANY government– think that it has the right to dictate what we can or cannot ingest?  I can understand regulating our public behavior— no one wants drunks or stoners staggering around in public, being obnoxious or dangerous, but I cannot imagine the justification for dictating what can or cannot be ingested in one’s home, let alone a plant that grows naturally.

Infringements on our right occurs because we LET them occur.  When police violate our Constitutional rights– when they harass, search, detain, with no probable cause– we cower and obey, whether they have the legal right or not.  We should create an uproar, like that in Ferguson (not violent, though), every time our government denies us our Constitutional rights, whether the subject is guns, drugs, cannabis, illegal spying, or other demands, and get widespread media attention.  If we don’t demand our rights, they will be removed.

You have all read about the frog in boiling water, but I will remind you, nevertheless.  If you put a frog into hot or boiling water, it will immediately jump out, but if you put in in cool water, then gradually raise the temperature, you will kill the frog, since it will die before it notices that the water is hot.  Well, this same analogy depicts what is happening to our Constitutional rights.  Little by little, the government ILLEGALLY usurps power, and if we don’t cry FOUL, they get away with it.  Just look at the seizure laws– cops can take everything you own, without charging you with a crime, and your life is ruined, in COMPLETE defiance of Constitutional rights!

I urge you to raise holy hell (non-violently) and get as much media attention as you can, every time a Constitutional right is denied.  It’s time to take back our government from this control freaks, and restore it to WE, THE PEOPLE!

In a stunning op-ed released Friday, the NY Times finally admitted that “assault weapons” are a made-up political term fabricated by anti-gun Democrats.

Op-ed writer Lois Beckett also admitted that once the term was manufactured and used to outlaw a class of weapons that dishonest anti-gun Democrats had used to con an entire nation, nothing happened.

“Two separate ads from the Americans for Responsible Solutions suggest McSally is opposed to closing the “gun show” loophole that allows individuals to buy guns without a background check, as well as online transactions.”

The Giffords ads are full of falsehoods. First, there isn’t any ‘gun show loophole.’ A loophole is something that occurs without the author of the law realizing it. The Congress specifically exempted private, person to person, father to son, father to daughter, uncle to nephew (you get the idea) sales, as they should have and should continue to do so.

Another huge falsehood : Those adjudicated mentally defective are entered in to the NICS in Arizona. They have been for years. It is the law. So a person who has been adjudicated as such, they will fail a background check today, tomorrow, next week, etc.

Yet another misleading claim in the Giffords ad is the implication that because a firearm is sold on line, there is no background check performed on the buyer. FALSE!

Any place a FFL sells a firearm, a gun show, their store, in a newspaper ad, Craigslist, or an on line auction like, a background check must be performed on the buyer. Most on line sales listings are from FFLs.

That written, if a private, person to person sale takes place, again, between two, UNLICENSED individuals, then no, a background check does not have to take place on the buyer.

The Congress does not have the jurisdiction to require two consenting adults from transferring ones private property to another to take the firearm to a FFL, pay a $75 or more tax, before the firearm can be transferred to the purchaser.

Then, of course, there is the assertion that enacting a universal background check law, a law that would require EVERY transfer, including the shotgun bequeathed by Grandpa to his Grandson/daughter, to go through a FFL where a transfer tax will be charged (a fee the FFL will charge for their time and labor), will save lives. It can not and will not.
